INFORMATION ON PROCESSING PERSONAL DATA MARINA
INTRODUCTION
Marina Punat d.o.o., OIB: 52846613956, address: Puntica 7, Punat, would like to provide you with information about the purposes, legal basis and other conditions concerning the processing of personal information.
Marina Punat d.o.o. is the controller of the personal data, and pursuant to the General Data Protection Regulation (GDPR) and the Act on Implementation of the General Regulation, and its General Personal Data Protection Policy of the Marina Punat Group, processes and protects your personal data.
PURPOSE OF PROCESSING PERSONAL DATA
We process your personal data for the following purposes:
Provision of vessel berth services
Marina Punat d.o.o. provides its contractual clients with different packages of vessel berth services, that differ in terms of the location/type of berth and additional services, depending on the needs and wants of clients.
For the purpose of drafting offers, we collect personal data on the client and/or their proxy, and on the vessel – name and surname, e-mail address and contact telephone number, and information about the vessel.
The legal basis for this processing is conducting pre-contractual activities at your request. If you do not provide the necessary data, we will not be able to draft an offer in line with your needs.
After you have contracted the vessel berth services, your personal data and/or the data of your proxy are processed for the purpose of fulfilling the rights and responsibilities from the berth contract and the provision of services. This processing includes personal data such as name and surname, address of residence, primary and secondary contact information (e-mail and telephone), name and registration of the vessel, data on the services used, data on invoicing and payments.
All contractual clients are issued a client card that allows free access to the marina and use of parking. For this purpose, Marina Punat d.o.o. processes the name and surname of the contractual client, and controls all entrances into and exits from the marina.
Marina Punat d.o.o. sends all of its contractual clients a weekly report on the state of the vessel as part of its regular services. This report includes a photograph of the vessel and description of any activities performed on the vessel in the last seven days. For the purposes of reporting, we use the e-mail address, name and surname of the contractual client and data on the vessel.
The legal basis for the above processing is the contract concluded between you, as the contractual client and/or proxy, and the company Marina Punat d.o.o. as the controller of personal data processing, and if you do not provide the necessary data, we will not be able to provide you with these services.
Provision of accommodation services in the floating holiday home
Accommodation in the Floating Holiday Home can be reserved directly on our website or via a reservation platform. When you submit the request for a reservation, we collect only essential data – your name and surname, e-mail address and/or telephone number, and other information needed in order to provide information as to the availability of the accommodations.
The legal basis for this processing is conducting pre-contractual actions at your request. If you do not submit the essential data, we will not be able to respond to your inquiry or request for a reservation.
According to specific national regulations of the Republic of Croatia, we are required to register every guest in the e-Visitor Tourist registration information system. For this purpose, we collect the data contained within the guest’s personal identification document (national ID card or passport), and enter them into the e-Visitor system.
The legal basis for this processing is the legal requirement of the company Marina Punat d.o.o., and if you do not provide the necessary personal data, we cannot register you as a guest and provide you services.
Provision of additional services via the mobile application
Contractual clients may access information about the vessel listed in the berth contract (name, type and dimensions of vessel, contracted berth) via the Marina Punat d.o.o. mobile application. Via the mobile application, contractual clients have access to information about activities conducted on the vessel, inventory status, and data on outstanding invoices and payment balances. Also available are photographs of the vessel, live feed of the marina via webcams, weather data, marina news, information about services offered, and contact data in the marina.
All those using the mobile application register using their e-mail address or user name and password.
The legal basis for this processing is the contract concluded between you as the contractual client and/or proxy of the mobile application and the company Marina Punat d.o.o. as the controller of the data processing, and if you do not provide the necessary data, we cannot provide this service.
Direct marketing, information about new offers, and determining customer satisfaction with our services
We use your e-mail address to send out newsletters about our services, special offers, benefits, discounts and new services we offer, that we think could be interesting and useful to you, as the user of our services.
In this case, we process your data based on our legitimate interest.
You may simply unsubscribe from our newsletter list at any time, by selecting that option at the bottom of every sent newsletter.
To our contractual users we will occasionally send, to the provided email address, a questionnaire with a link to an anonymous survey on satisfaction with the services provided.
In the mentioned processes, we process the data based on our legitimate interest.
If you register for our newsletter as a user of our website, the legal basis for processing your data (contact e-mail address) is the consent you give, which you may retract at any time, and we will then no longer process your data for this purpose.
Resolution of complaints and replies to inquiries
We also process your information for the purpose of providing all information that you have requested from us, verbally, or via e-mail, the web contact form or telephone. Depending on the type of request, this processing is based on your consent, and may pertain to taking pre-contractual actions regarding your request and fulfilling the rights and responsibilities from our contractual relations (if you are our contractual client).
As a consumer, you have the right to submit a written complaint concerning the services provided. The data you have submitted to us, and any additional data that we may have requested from you, are processed exclusively for the purpose of resolving your complaint.
The legal basis for processing personal data ensues from the contractual relations, since the complaint is concerning a service provided or the procedure of contracting services.
Video surveillance
Video surveillance has been installed at several locations within the marina, for the purpose of protection of persons and property. The legal basis for this processing is the legitimate interest of the company Marina Punat d.o.o.
At every location where video surveillance has been installed, there is a clearly visible notification containing the basic information about data processing.
RECIPIENTS OF PERSONAL DATA
In certain business processes, such as information support tasks and accounting, we use the service of reliable partners (processors of the data). When necessary, processors process your personal data and/or the data of your proxy in line with our instructions, while securing the appropriate technical and organisational measures to protect personal data.
Pursuant to the legal requirements, we are required to enter your data into the e-Visitor central tourist registry system. The data from the e-Visitor system are used by the authorized state bodies in the Republic of Croatia (Ministry of the Interior, Ministry of Tourism, Customs Administration, etc.) for the purposes as defined by the national regulations.
In special situations, as part of investigations and other official actions performed by authorised public bodies, we will be required to submit the requested data that we process (e.g., pursuant to a request by the Ministry of the Interior, Croatian State Prosecutor’s Office, competent courts, etc.).
The company does not forward your personal data to any recipients outside the European Union.
PERIOD OF KEEPING PERSONAL DATA
Marina Punat d.o.o. keeps data in accordance with the criteria stipulated in the legal regulations, or from obligations ensuing from contractual relations for vessel berthing services.
The data we collect and process pursuant to your consent will be deleted immediately upon your retraction of that consent, unless there is another legal basis for further processing or keeping data.
The data we process pursuant to our legitimate interest will be kept in the minimum time period that is required to achieve the purpose of the processing.
RIGHTS IN PROCESSING PERSONAL DATA
Depending on the legal basis and manner of processing, you have the following rights:
Right to information about processing, and access to and a copy of the data;
Right to correct incorrect and/or supplement incomplete data;
Right to delete data (if there is no longer a legal basis for their further processing or keeping).Where applicable, and depending on the manner of data processing and the legal basis, the following rights are available to you:
Right to restrict processing;
Right to the transferability of data;
Right of complaint against processing based on the legitimate interest of the company Marina Punat d.o.o.;
Right to retract previously granted consent for data processing.
Right to complain to the supervisory body
If you believe that the processing of your personal data is contrary to the General Data Protection Regulation, you have the right to file a complaint to the competent supervisory body.
